How to set up your SMS disclosure language

Learn how to create SMS disclosure language on the account-level, making it easy to add to your sign-up forms and subscribe pages.
Note that this article is only for people who have not already set up their disclosure language; it is only for those who didn’t complete that step in the SMS setup wizard.

Disclosure language best practices
Disclosure language is critical to SMS compliance. By law, you need to include it anywhere you’re collecting SMS consent.
It's a best practice to place this language above the SMS opt-in button in a form or subscribe page, so your customers read it before subscribing.
Before you begin
Before creating your disclosure language, you must:
- Turn on SMS in Klaviyo
- Create your mobile terms of service
- Set up a privacy policy and update it to adhere to the best practices for SMS
About disclosure language
Your disclosure language should:
- Be tailored for the country where you have the short code.
- Specify the name of the keyword, button, etc.
- Include examples of each type of message.
- For promotional, it could be: “promos or cart reminders.”
- For transactional, it could be: “updates, alerts, and information.”
- Share the following information (along with your company’s information):
- Service description and name.
- Message frequency (e.g., “Message frequency varies”).
- Contact info for information and opting out of the short code program (e.g., “Text HELP for help. Text STOP or click the unsubscribe link to opt out.”)
- Links to your short code program TOS and your privacy policy (e.g., “Terms of Service: [Link to SMS terms of service]. Privacy Policy: [Link to privacy policy].”)
- Include the following (if required):
- Message and data rates may apply.
- Consent is not a condition of purchase.
- By consenting, you agree to receiving messages sent by autodialer.
Create your SMS disclosure language
- Click your organization name in the bottom left corner.
- Navigate to Settings > SMS > Terms of Service.
- Scroll down to SMS Opt-in disclosure.
- Click Configure opt-in disclosure.
- On the SMS Opt-in Disclosure menu, add your:
- Full company name
- A link to your privacy policy
- A link for your Terms of Service
- Check the box labeled I have updated my privacy policy to include SMS sending information.
- Click Submit.
Sample disclosure language
By default, Klaviyo provides the following disclosure language:
"By submitting this form, you consent to receive informational (e.g., order updates) and/or marketing texts (e.g., cart reminders) from [Company Name] including texts sent by autodialer. Consent is not a condition of purchase. Msg & data rates may apply. Msg frequency varies. Unsubscribe at any time by replying STOP or clicking the unsubscribe link (where available). Privacy Policy [LINK] & Terms [LINK]."
However, if you plan to apply for a short code in either the United States or New Zealand, you may need to adapt this language so your application can be approved.
United States
“Optional: By entering your number and clicking [SUBSCRIBE KEYWORD], you agree to receive marketing and promotional messages and/or non-marketing updates and information from [COMPANY NAME] at the number provided. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. Reply HELP for help or STOP to cancel. View our Privacy Policy [insert link] and Terms of Service [insert link].”
For sweepstakes and abandoned cart: Add “sweepstakes” or “cart reminders” in the program description: "Optional: By entering your number and clicking [SUBSCRIBE KEYWORD], you agree to receive marketing and promotional messages (e.g., sweepstakes and cart reminders)."
New Zealand
“By entering your phone number and submitting this form, you consent to receive marketing text messages (such as promotion codes and cart reminders) from [Your Organization's Name] at the number provided. Consent is not a condition of any purchase. Message frequency varies. You can unsubscribe at any time by replying STOP or clicking the unsubscribe link (where available) in one of our messages. View our Privacy Policy [insert link] and Terms of Service [insert link].”
